1. Copyright ownership

All content published on this website (the “Site”) — including but not limited to text, headings, written copy, photographs, video footage, illustrations, icons, graphics, page layouts, visual design, look and feel, compilations of data, and the underlying HTML, CSS and JavaScript source code — is the property of Proseal Plus Inc. or of its content suppliers, and is protected under the Copyright Act (R.S.C., 1985, c. C-42) of Canada and by international copyright treaties, including the Berne Convention.

Copyright in original works created by Proseal Plus Inc. or created for Proseal Plus Inc. under a written assignment subsists automatically upon creation and fixation; registration with the Canadian Intellectual Property Office is not required for those rights to exist or to be enforced.

Any content on the Site supplied by a third party — including licensed photography, embedded maps and web fonts — remains the property of its respective owner and is used by Proseal Plus Inc. under licence.

2. Trademarks

“Proseal Plus”, “Proseal Plus Inc.”, the Proseal Plus logo, and the road-and-cross device mark are trademarks of Proseal Plus Inc., whether registered or used at common law. Nothing on this Site grants any licence or right to use any trademark of Proseal Plus Inc. without our prior written permission. All other product, company and service names appearing on the Site are the trademarks of their respective owners and are used for identification purposes only.

3. Limited licence to use this Site

Proseal Plus Inc. grants you a limited, non-exclusive, non-transferable, revocable licence to access the Site and to view, download and print its content solely for your own personal, non-commercial purposes in connection with evaluating or purchasing our services. This licence is conditional on your leaving all copyright, trademark and other proprietary notices intact on any copy you make.

4. Restrictions

Except as expressly permitted in section 3, or as permitted by a mandatory exception under the Copyright Act (such as fair dealing for the purpose of research, private study, education, parody, satire, criticism, review or news reporting, with proper attribution), you may not, without the prior written consent of Proseal Plus Inc.:

• reproduce, republish, distribute, transmit, broadcast or communicate any part of the Site to the public by telecommunication;
• copy, scrape, mirror, frame or archive the Site or any substantial part of it, whether by automated means or otherwise;
• modify, adapt, translate or create derivative works from any content on the Site;
• use any content of the Site for any commercial purpose, including in advertising, tenders, listings or competing websites;
• use our photographs of completed work to represent work performed by any other person or business;
• remove, obscure or alter any copyright, trademark or other proprietary notice; or
• use any data-mining, robot or similar data-gathering or extraction tool on the Site, including for the purpose of training machine-learning or artificial-intelligence systems.

Unauthorized use of the Site or its content may give rise to a claim for damages, statutory damages, an accounting of profits, and/or injunctive relief, and may constitute an offence under applicable law.

5. Project photography and customer sites

Photographs and video appearing on the Site depict work actually performed by Proseal Plus Inc. They are provided as examples of workmanship. Individual results vary with site conditions, materials, drainage, base preparation and weather, and no photograph should be taken as a representation or warranty as to the outcome of any particular project.

6. Pricing, estimates and information accuracy

Information on the Site is provided for general information only and may be changed at any time without notice. Any price, rate or figure appearing on the Site is an approximate indication only, is not an offer capable of acceptance, and does not form a binding quotation. A binding price is provided only in a written estimate issued by Proseal Plus Inc. following an in-person site visit. While we take reasonable care to keep the Site accurate and current, we do not warrant that it is free of errors or omissions.

7. Disclaimer and limitation of liability

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Proseal Plus Inc. disclaims all representations, warranties and conditions of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, in respect of the Site.

To the fullest extent permitted by applicable law, Proseal Plus Inc. and its directors, officers, employees and contractors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your access to or use of the Site, whether based in contract, tort (including negligence), statute or otherwise, even if advised of the possibility of such damages.

Nothing in this notice limits or excludes any liability that cannot be limited or excluded under applicable law, including under the Consumer Protection Act, 2002 (Ontario).

8. Third-party links and embedded content

The Site contains links to third-party websites, including our social media profiles, as well as embedded third-party content such as mapping services and web fonts. Those sites and services are not under our control. Proseal Plus Inc. provides such links and embeds for convenience only, does not endorse and is not responsible for the content, accuracy, availability or privacy practices of any third-party site or service, and your use of them is governed by their own terms.

9. Information you send us

Personal information you submit through the estimate request form or by email — such as your name, email address, telephone number, project address and message — is collected and used solely to respond to your enquiry, prepare an estimate and provide the services you request, in accordance with the Personal Information Protection and Electronic Documents Act (S.C. 2000, c. 5). We do not sell your personal information. You may ask us to access, correct or delete the personal information we hold about you by contacting us using the details in section 12.

By submitting a message through the Site you confirm that the information you provide is accurate and that you are authorized to provide it, and you consent to being contacted by telephone, text message or email in response to your enquiry.

10. Claims of copyright infringement

Proseal Plus Inc. respects the intellectual property rights of others. If you believe that material on this Site infringes your copyright, please send a written notice to the address in section 12 that includes: your contact information; identification of the work claimed to be infringed; identification of the material on the Site said to infringe it, with the URL where it appears; the reason you believe the use is not authorized; and a statement that the information in your notice is accurate. We will review any properly submitted notice in accordance with the notice-and-notice regime under sections 41.25 to 41.27 of the Copyright Act, and will remove or disable access to infringing material where appropriate.

11. Governing law

This notice and any dispute arising out of or in connection with the Site or its content are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario.
